Attorney Dan Hassinger
Illinois Secretary of State Hearings

If your driver's license has been suspended or revoked due to an arrest for DUI or another alcohol related offense, you may be eligible for relief through the Illinois Secretary of State Department of Administrative Hearings.

The petitioner in an administrative hearing must prove that he/she should be granted relief. Relief is discretionary; but, Title 92 of the Illinois Administrative code provides in part:

In no event shall the Secretary issue such license unless and until such person has had a hearing pursuant to the Code and the appropriate administrative rules and the Secretary is satisfied, after a review or investigation of such person, that to grant the privilege of driving a motor vehicle on the highways will not endanger the public safety or welfare.
